Peaceful Living NH LLC
Effective Date: March 24, 2026
These Terms of Service govern the Virtual Garden Consultation Services and Garden Design Services provided by Peaceful Living NH LLC (“Company,” “we,” “our,” or “us”). By scheduling, purchasing, requesting, or participating in any consultation or design service, the client (“Client,” “you,” or “your”) agrees to be bound by these Terms of Service.
1. Client cooperation
Client Cooperation. The Client agrees to provide accurate and complete information, including photographs, measurements, site conditions, goals, and other requested details necessary for the Company to provide consultation or design services. Delays in providing required information may delay the project timeline.
2. Project inactivity
Project Inactivity. If the Client fails to provide requested information, approvals, or communication for thirty (30) days after a request from the Company, the project may be placed on hold or considered abandoned. Fees paid for work already completed are non-refundable.
3. Nature of the Consultation
The garden consultation service and garden design services provided by Peaceful Living NH LLC are intended for educational and informational purposes only.
Recommendations are based on general horticultural knowledge, experience, and information provided by the client. Gardening results vary widely depending on environmental factors, soil conditions, weather patterns, pest pressures, plant health, and other variables beyond our control.
Peaceful Living NH LLC does not guarantee plant survival, crop yields, pest control outcomes, or garden performance.
4. Client Responsibility
All decisions and actions taken by the Client following the consultation are the sole responsibility of the Client.
Peaceful Living NH LLC is not responsible for:
- Planting outcomes
- Plant health or survival
- Garden construction
- Soil amendments or fertilizer use
- Pest or disease management results
- Property damage related to gardening activities
Clients should research and follow all safety instructions and product labels for gardening tools, fertilizers, soil amendments, and pesticides.
5. Implementation of Recommendations
Peaceful Living NH LLC provides guidance and recommendations only. The company does not supervise or control how recommendations are implemented.
Improper installation, planting technique, watering practices, or environmental conditions may negatively impact results.
6. Plant Safety Disclaimer
Some plants recommended during consultations may be toxic or harmful if ingested by humans or animals.
Peaceful Living NH LLC does not guarantee that plants discussed during consultations are safe for children, pets, or livestock.
Clients are solely responsible for:
- researching plant toxicity
- determining suitability for their household
- ensuring plants are placed safely in their environment
Peaceful Living NH LLC shall not be held responsible for illness, injury, harm, or death resulting from plant exposure or ingestion.
7. Environmental Factors
Garden success is affected by many environmental Conditions beyond our control, including but not limited to:
- weather and climate
- frost or extreme temperatures
- pests and wildlife
- soil composition
- disease pressure
- drought or excessive rainfall
Peaceful Living NH LLC cannot guarantee outcomes affected by these variables.
8. Limitation of Liability
To the fullest extent permitted by law, Peaceful Living NH LLC shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use or implementation of consultation advice or garden design services.
By participating in a garden consultation or garden design service with Peaceful Living NH LLC, the Client acknowledges that gardening activities involve inherent risks including but not limited to:
- injury from tools or equipment
- exposure to insects, plants, or allergens
- plant failure or crop loss
- property damage
- financial loss
- injury related to gardening activities
The Client agrees that they voluntarily assume all risks associated with implementing any recommendations provided during consultation or during garden design services.
To the fullest extent permitted by law, the Client agrees to release, waive, and hold harmless Peaceful Living NH LLC and its representatives from any claims, damages, losses, liabilities, or expenses arising from the use or implementation of consultation advice.
9. No Guarantee of Results
Garden consultations and garden design services are based on horticultural experience and general growing principles. However, gardening outcomes depend on numerous factors outside the control of Peaceful Living NH LLC, including, but not limited to:
- soil conditions
- weather patterns
- pests and wildlife
- watering practices
- sunlight exposure
- plant quality and health
- environmental conditions
Because of these variables, Peaceful Living NH LLC makes no guarantees regarding plant survival, garden productivity, pest control success, or aesthetic results.
The Client understands that all gardening recommendations are suggestions only and agrees that results may vary.
10. Limitation of Advice
Consultation advice, and garden design services are intended only for the specific garden situation described by the Client. Recommendations may not be suitable if applied to other locations, conditions, or properties.
The Client agrees not to rely on consultation advice and/or garden design service for purposes beyond the scope of the consultation.
11. Accuracy of Client Information
Consultation advice and garden design services are based on the information provided by Client.
Clients agree to provide accurate information regarding:
- location
- growing conditions
- soil conditions
- sunlight exposure
- pest issues
- garden history
- And any other information required to complete a garden consultation or a garden design service
Incorrect or incomplete information may affect the accuracy of the recommendations.
12. Online Consultation Services
Consultations and garden design services’ meetings may be conducted through online video platforms such as Zoom or Google Meet.
Clients are responsible for ensuring:
- stable internet access
- proper camera positioning when showing garden areas
- the ability to upload photos when requested
Technical issues may limit accuracy of assessments.
13. Garden Design Services Disclaimer
Peaceful Living NH LLC may offer garden design services, including suggested plant selections, planting layouts, garden bed concepts, color schemes, pollinator gardens, edible gardens, cottage gardens, and other planting recommendations.
Garden design services are intended for educational, aesthetic, and horticultural purposes only.
Garden design services do not include:
- Landscape architecture
- Engineering services
- Land surveying
- Drainage design
- Grading plans
- Erosion control plans
- Structural design
- Construction drawings
- Utility location services
- Property line verification
- Code compliance reviews
- Permit acquisition
- HOA compliance review
Any sketches, layouts, diagrams, concepts, or recommendations provided by Peaceful Living NH LLC are conceptual in nature and should not be relied upon as construction documents.
The Client is solely responsible for obtaining any permits, approvals, inspections, surveys, utility markings, or professional services required by law before implementing any garden or landscape project.
Where a project involves drainage concerns, retaining walls, slopes, structures, electrical systems, irrigation systems, property boundaries, or other specialized matters, the Client should consult appropriately licensed professionals.
Peaceful Living NH LLC makes no guarantee that a garden design will meet local zoning requirements, HOA restrictions, building codes, permit requirements, or other regulatory standards.
14. Limited license for design materials
Limited License. Upon full payment, the Client is granted a non-exclusive, non-transferable license to use the final garden design materials for personal use on the Client’s property. The Client may not reproduce, distribute, sell, publish, or use the design materials for commercial purposes without the Company’s prior written consent.
15. Plant Availability and Substitutions
Garden designs and recommendations are based on plant availability at the time of consultation or design preparation.
Plant availability may change due to seasonal inventory, supplier shortages, crop failures, weather conditions, or other factors beyond our control.
Peaceful Living NH LLC does not guarantee that specific plant varieties will be available at the time of installation.
Reasonable substitutions may be recommended when necessary.
16. Garden Design Deliverables and Revisions
Garden design services are limited to the specific deliverables described at the time of purchase.
Unless otherwise stated in writing:
- One initial design concept is included.
- One round of reasonable revisions is included.
- Additional revisions, redesigns, site changes, or scope expansions may require additional fees.
Design services are based on the information, measurements, photographs, and property details provided by the Client. Peaceful Living NH LLC is not responsible for errors resulting from inaccurate measurements or incomplete information provided by the Client.
17. Photo Submissions and Use
Clients may be asked to submit photos of their garden, soil, plants, or property prior to consultation.
By submitting photos, videos, or other media (“Client Content”) to Peaceful Living NH LLC, the Client represents that they have the legal right and authority to share such content.
Client Content will be used solely for the purpose of providing consultation services unless otherwise agreed.
18. Third-Party Sharing
Peaceful Living NH LLC will not share, distribute, or disclose Client Content to any third party without the Client’s prior written consent, except as necessary to:
- provide the requested services (for example, working with a contractor or specialist at the Client’s request), or
- comply with applicable laws or legal obligations
19. Optional Use with Permission
With the Client’s explicit written consent, Client Content may be used for additional purposes, including but not limited to:
- educational materials
- marketing or promotional content
- social media or website content
The Client may grant or deny such permission at their sole discretion.
20. Acceptable Use of Photograph Submission
Appropriate Content Requirement
Clients agree that any photographs, videos, or other materials (“Client Content”) submitted to peaceful Living NH LLC must be appropriate for a professional business environment.
Client Content must not include, depict, or contain:
- Sexually explicit or suggestive material
- nudity or pornographic content
- obscene, offensive, or abusive material
- illegal activities or content that violates any laws or regulations
- content that infringes on the rights of any third party
21. 60 Minute Consultation Payment and Scheduling
60 Minute consultation fees must be paid in advance at the time of booking through our scheduling platform.
Appointments may be scheduled through Square or another approved scheduling service.
Appointments must be booked at least 72 hours in advance unless otherwise stated.
22. Garden Design Payment & Revisions
Payment Terms
A 50% non-refundable deposit of the selected garden design package is required at the time of booking to reserve your garden design consultation. The remaining 50% balance is due upon completion of the design and must be paid before the final garden design rendering and any associated files are delivered.
Design Revisions
Your garden design package includes one round of revisions to ensure the final design reflects your vision. Revision requests should be submitted within 7 days of receiving your initial design proposal.
A revision may include adjustments such as:
- Plant substitutions
- Minor layout modifications
- Changes to color palettes or plant selections
- Other reasonable refinements discussed during the design process
Revisions that significantly alter the original design scope—such as redesigning large portions of the landscape, changing the project location or dimensions, or adding new garden areas not included in the original consultation—may require additional design time and will be quoted separately before work begins.
Once the final balance has been paid, the completed garden design, rendering, and any included documents will be delivered electronically.
23. Cancelations and Rescheduling
Clients may reschedule or cancel appointments within the time limits specified during booking.
Failure to attend a scheduled consultation may result in forfeiture of the consultation fee.
24. Garden Design Service Refund Policy
Garden design services are custom creative services prepared specifically for each client. Because time is reserved for planning, research, design development, and preparation of personalized recommendations, payments are subject to the following refund policy.
Deposit & Payment Terms
A 50% non-refundable deposit is required at the time of booking to reserve your design project and begin work.
The remaining balance is due upon completion of the design before final design materials are delivered.
Cancellation Before Work Begins
If you cancel your garden design project before design work has started, any payments beyond the non-refundable deposit may be refunded.
The initial deposit is retained to cover administrative time, project preparation, scheduling, and processing.
Cancellation After Work Has Begun
Once design work has started, payments are non-refundable because time has been invested in creating a customized garden plan and recommendations.
25. Design Revisions
Garden design packages include one reasonable revision request based on the original project scope.
Additional revisions, significant changes, or requests that expand beyond the original scope may require an additional fee before further work begins.
26. Client Delays
Projects delayed due to missing information, unavailable communication, or failure to provide requested photos, measurements, or site details may be placed on hold. Refunds are not provided for delays caused by the client.
27. Intellectual Property
Any written plans, recommendations, documents, or materials provided by Peaceful Living NH LLC remain the intellectual property of the company.
Materials are for personal use only and may not be reproduced, redistributed, or sold without written permission.
28. No Professional Agricultural, Engineering, or Medical Advice
Consultation services and garden design service do not constitute professional advice in the fields of:
- Agriculture licensing
- engineering
- pest control certification
- veterinary or medical services
Clients should consult licensed professionals where required by law.
29. Code of Conduct & Right to Terminate Services
Professional Conduct requirement
Clients are expected to conduct themselves in a respectful and professional manner during all interactions with Peaceful Living NH LLC, including but not limited to video consultations, phone calls, messaging, and email communication.
Clients agree not to engage in any inappropriate, offensive, or disruptive behavior, including but not limited to:
- use of abused, threatening, or discriminatory language
- harassment or intimidation
- sexually explicit language or behavior
- inappropriate exposure or conduct on camera
- any behavior that creates an unsafe or uncomfortable environment
30. Right to Terminate Consultation & Garden Design Service
Peaceful Living NH LLC reserves the right to immediately terminate or end any consultation or garden design Service, without prior notice, if a client engages in behavior deemed inappropriate, unsafe, or in violation of these Terms of Service.
This includes, but not limited to:
- inappropriate language
- harrasment
- sexual or indecent exposure
- any form of misconduct during a live session
Peaceful Living NH LLC reserves sole discretion in determining what constitutes inappropriate conduct.
31. No Refund Policy for Misconduct
If a consultation or garden design service is terminated due to a violation of this Code of Conduct, the Client shall not be entitled to a refund.
32. Future Service Refusal
Peaceful Living NH LLC reserves the right to refuse future services to any Client who violates these conduct standards.
33. Indemnification
The Client agrees to indemnify, defend, and hold harmless Peaceful Living NH LLC and its representatives from and against any and all claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising out of:
- the Client’s use or misuse of consultation advice and/or garden design services
- actions taken based on recommendations
- violation of these Terms of Service
- any third-party claims related to the Client’s garden or property
34. Dispute Resolution
Any disputes arising from services provided by Peaceful Living NH LLC shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes may be submitted to mediation or binding arbitration in the State of New Hampshire, as permitted by law.
35. Refund Policy
Due to the time-based nature of consultation services, all sales are final unless otherwise stated. Refunds are not provided for completed consultations. Rescheduling may be permitted with the timeframe outlined at booking.
36. No Ongoing Obligation
Consultation services are limited to the scheduled session and any explicitly stated follow-up. Peaceful Living NH LLC is not responsible for ongoing support, monitoring, or updates unless separately agreed in writing.
37. Recording and Privacy
Consultations and garden design services may not be recorded, reproduced, or distributed by the Client without prior written consent from Peaceful Living NH LLC.
Peaceful Living NH LLC will not record consultations and/or garden design services without notifying the Client in advance.
38. General Information Disclaimer
All content provided on the Peaceful Living NH LLC website, social media, and related platforms is for educational purposes only and does not constitute personalized consultation advice.
39.Severability
Severability. If any provision of these Terms of Service is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
40. Force Majeure
Peaceful Living NH LLC shall not be liable for failure to perform services due to circumstances beyond its reasonable control, including but not limited to internet outages, power failures, weather events, or other unforeseen events.
41. Remote Consultation and Garden Design services Disclaimer
Garden consultations and garden design services conducted remotely rely on photos, video, and information provided by the Client. Because the Company cannot physically inspect the property, recommendations may be limited and may not reflect all conditions present on site.
42. Entire Agreement
These Terms of Service Constitute the entire agreement between the Client and Peaceful Living NH LLC and supersede any prior communication or understandings.
43. Governing Law
These Terms of Service shall be governed by the laws of the state of New Hampshire.
44. Acceptance of Terms
By booking or participating in a garden consultation with Peaceful Living NH LLC, the Client acknowledges that they have read, understood, and agree to these terms of Service.
